The petitioner is accused in connection with Piar P.S. Case No. 08 of 2018 registered under Sections 272, 273 of the IPC and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act.
The accusation is that on receiving secret information, police apprehended the petitioner while he was coming on a motorcycle with a plastic bag, containing 12 bottles of 750 ml and 20 bottles of 375 ml. He disclosed the name of his associate as Sakindra Sah who succeeded in fleeing away.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.7682 of 2018 (2) dt.08-02-2018 2/2 petitioner was moving on the road at that time and he was apprehended only on mere suspicion, he has been falsely implicated in this case. The real culprit, who was carrying the illicit liquor, managed to flee away. It is further submitted that petitioner has no criminal antecedent and is in custody since 10.01.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur, in connection with Piar P.S. Case No. 08 of 2018. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) sushma/- U T
