Petitioner, already in custody, seeks bail in connection with Kotwali (Jogsar) P.S. Case No.850 of 2017 (G.R. Case No.6214 of 2017), registered under Sections 363, 365 and 376(D) of the Indian Penal Code as well as under Sections 4/6 of the POCSO Act.
Allegation in brief is that FIR named accused person Manish kidnapped the prosecutrix and along with another accused Sunny committed rape by administering wine. Learned counsel for the petitioner submits that petitioner is not named in the FIR and only material transpired against him is that victim has stated that during confinement he used to torture
Patna High Court Cr.Misc. No.9615 of 2018(2) dt.19-02-2018 2/2 her but there is no allegation of committing rape moreover he has been impleaded because he is brother of the wife of Manish and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, petitioner Rajeev Kumar Singh @ Rajeeb Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Bhagalpur in connection with Kotwali (Jogsar) P.S. Case No.850 of 2017 (G.R. Case No.6214 of 2017).
