2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 409, 420, 467, 468/34 of the Indian Penal Code.

3. There is allegation that this petitioner alongwith other co-accused persons made interpolation in the list of beneficiaries and distributed the flood relief to fictitious persons.

4. It is submitted on behalf of petitioner that the alleged list was prepared collectively by the said committee. Petitioner was only a member of the monitoring committee. He had no role in distribution of flood relief in the year 2017. There is no allegation that petitioner defalcated or embezzled government money. Some of the similarly situated co-accused

Patna High Court CR. MISC. No.69313 of 2023(2) dt.09-11-2023 2/2 persons have already been granted anticipatory bail by coordinate Benches of this Court. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Biraul, District Darbhanga in connection with Jamalpur P.S. Case No. 04 of 2023, corresponding to G.R. No. 21 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
