Mr. ANIL PRASAD SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Jhajha P.S. Case No. 125 of 2017 instituted for the offence under Sections 147,149,323,302 of the IPC.

It is alleged in the written report that on the date of occurrence the petitioner along with other accused person as named in the written report assaulted the son of the informant with fists, slaps, leg etc. causing serious injuries in his stomach and his intestine got burst. Thereafter, villagers assembled and rescued the son of informant and brought him to doctor for treatment from where he was referred to higher treatment but ultimately the son of informant died. The case diary has been received, wherein, post-mortem report is available and doctor

Patna High Court Cr.Misc. No.8409 of 2018(3) dt.06-03-2018 2/2 has found three injuries on the person of deceased, including bleeding from both nostril and mouth and fracture in left side of rib caused by hard and blunt substance.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioners.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law and disposed off preferably on the same day, without being prejudiced by this order.
