====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 18-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.2.2018, seeks bail in Kiul GRPS Case No. 291 of 2017 registered under Section 379 of the IPC.

The allegation in brief is that mobile, suitcases and other items of the informant were stolen while traveling in a train. Learned Counsel for the petitioner submits that the FIR is against unknown, nothing has been recovered from the possession of the petitioner rather he has been made accused on the basis of statement of one Sony Kumari from whose possession one of the mobiles has been recovered, who is co-villager and falsely implicated the petitioner that she has purchased the mobile from him, however the petitioner has no criminal antecedent and is in custody since 2.2.2018.

Having considered the said facts and circumstances, the petitioner, namely, Suraj Kumar Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Railway ACJM Kiul, Lakhisarai in connection with Liul GRPS Case No. 291 of 2017.
