Petitioner seeks bail in a case registered for the offences punishable under Sections 3/4 of the Explosive Substance Act.

Submission is that neither the seizure list nor the FIR nor the case diary would reveal that any explosive substance was recovered from possession of the petitioner. Without any material to substantiate that in fact the recovered material were explosive, there is no need to keep the petitioner behind the bar who has got no criminal antecedent.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.8069 of 2018 (3) dt.21-03-2018 2/2 satisfaction of learned Court below where the case is pending in connection with Belhar Police Station Case No. 251 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
