Petitioners seek bail in a case registered for the offences punishable under Sections 363, 364 and 120B/34 of the Indian Penal Code.
The petitioners were last seen along with the deceased while all were taking wine. Subsequently, dead body was
Patna High Court Cr.Misc. No.8745 of 2018 (3) dt.26-03-2018 2/2 recovered.
Submission of the learned counsel for the petitioners is that the post mortem report would reveal that no external injury was found on the person of the deceased. The petitioners are accused only for the reason that they were last seen with the deceased which is a very weak circumstance. Learned counsel for the informant opposed the prayer for bail.
Considering the submission of the petitioners aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Supaul Police Station Case No. 576 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
