Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft of motorcycle is against unknown.

Submission is that nothing was recovered from the possession or house of this petitioner nor the petitioner was ever put on TI Parade. Only material is confessional statement of co-accused Shivam Kumar. Petitioner is in custody since 07.12.2017. Investigation of the case is already complete. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the

No.21493 of 2018 (2) dt.17-04-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Phenhara Police Station Case No. 11 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
