The petitioner seeks regular bail in BegusaraiMufasil P.S. Case No.390 of 2017 registered for the offence under Sections 341, 409, 435, 427, 337, 504 and 506 of the I.P.C. Allegation against the petitioner is committing theft of electricity to run mobile tower in order to save diesel as well as putting hindrance in running the said tower.

Submission of the learned counsel for the petitioner is that, as a matter of fact, there was some dispute in between the petitioner and the informant and violation of the agreement. The petitioner filed an application on 26.6.2017 to the S.D.O., Begusarai for removal of tower from the plot in question which

Patna High Court Cr.Misc. No.53016 of 2017 (2) dt.21-11-2017 2/2 was forwarded to the Circle Officer, Begusarai due to which the present case has been filed. The petitioner is in custody since 6.9.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Begusarai, in Begusarai Mufassil P.S. Case No.390 of 2017 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence.

(3) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
