This application, for grant of anticipatory bail, arises out of Mansi Police Station Case No. 67 of 2019, disclosing offences under Sections 341/323/324/308/354-A/379/447/34 of the Indian Penal Code.

The allegation against the petitioners is that the petitioner no. 1 assaulted the informant on his left hand by means of iron-rod, petitioner no. 2 assaulted him by means of dabia and petitioner no. 4 pulled hair of the sister-in-law of the informant. There is no specific allegation against petitioner no. 3.

No.62101 of 2019(2) dt.22-10-2019 2/2 Learned Counsel for the petitioners submits that both the parties are agnates and there was dispute regarding harvesting of crops between them. He further submits that from perusal of the impugned order, it would be evident that there is no injury report on the record.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates and there appears to be dispute relating to land between them, I am inclined to grant the petitioners privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Mansi Police Station Case No. 67 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
