2. The petitioners apprehend their arrest in connection with Atri P.S. Case No. 184 of 2023, registered for the offences punishable under Section 379 of the Indian Penal Code, 4(IA), 21M.M.(D&R) Act 1957, Rule 56(i)(ii) BM (CPIMTS) 2019, Rule 11/18 & Amended Act 2021 under Rule 56.
3. As per allegation, having got a secret information, the informant along with raiding party reached at the place of occurrence and found the petitioner along with other accused persons, involved in illegal excavation of sand, which caused a
Patna High Court CR. MISC. No.72129 of 2023(2) dt.08-11-2023 2/2 loss of revenue of Rs. 9,10,557.
4. The learned counsel for the petitioners has submitted that the names of the petitioners have figured in confessional statement of the villagers. Except confessional statement of villagers, there is nothing against the petitioners in the entire case diary.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Atri P.S. Case No. 184 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
6. The learned court below shall verify the criminal antecedent of the petitioners and if it is found that they are involved in any other case except the cases mentioned in paragraph no. 3 of the bail petition, their bail bond shall not be accepted.
