JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Phulwaria P.S. Case No. 85/2019, disclosing offences under Sections 341, 323, 307, 448, 379, 354, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant by means of iron rod to the informant. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and although there is allegation of assault, however, injuries sustained by the informant were found simple in nature. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Begusarai, in connection with Phulwaria P.S. Case No. 85/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
