ANJANA MISHRA ORAL ORDER 14-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.07.2019 in connection with Excise Case No.159 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner.

Considering the fact that the alleged recoveries were from the Scorpio vehicle and not from the conscious possession of the petitioner and that he has been in bail in connection with one of the cases of similar nature and

Patna High Court CR. MISC. No.61933 of 2019(2) dt.14-10-2019 2/2 undertakes to present himself as and when required, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-Cum-Special Judge, Excise Act, Rohtas at Sasaram, in connection with Excise Case No.159 of 2019.
