2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code.

3. Earlier, the prayer for grant of bail of the petitioner was rejected by this Court vide order dated 25.10.2024 passed in Cr. Misc. No. 28331 of 2024.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, the deceased died in a train accident and petitioner has falsely been implicated in this case merely on suspicion. It is further submitted that till date, trial has not been concluded and the case is still running for prosecution evidence.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Sitamarhi in connection with Riga P.S. Case No. 371 of 2023.
