Petitioner, in the present case, is seeking regular bail in connection with Banka (Barahat) P.S. Case No. 550 of 2017 registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that as per the F.I.R. this petitioner was apprehended along with the co-accused while trying to take away the transformer and building angle by committing theft. Learned counsel submits that petitioner has no criminal antecedent, the co-accused has been granted regular bail by a co-ordinate Bench of this Court and the seizure list is in violation of Section 100 Cr.P.C.

Patna High Court Cr.Misc. No.4900 of 2018 (2) dt.02-02-2018 Learned counsel for the Sate is present and opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 550 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
