The petitioner is apprehending his arrest in connection with Laxmipur P.S.Case No.239/19 registered for offences punishable under Section 376 of the Indian Penal Code. As per FIR, petitioner is said to have committed rape upon the informant.

Submission of the learned counsel for the petitioner is that one day earlier he had been confined by the informant and others for which the police was informed.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the

Patna High Court CR. MISC. No.64734 of 2019(2) dt.16-10-2019 2/2 petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of the submission and the materials available in the case diary and be disposed of without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
