JUSTICE ARUN KUMAR ORAL ORDER 12-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Chapra Town PS Case No. 467 of 2017 registered under Section 307/34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that this petitioner was driving the motorcycle and one Naga was the pillion rider, it is alleged that Naga shot by revolver on the person of the informant causing injury in the left side of his head and thereafter he escaped away. Learned Counsel for the petitioner submits that the petitioner was driving the motorcycle and the allegation is against the pillion rider Naga, who opened fire and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Dhiraj Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Singh, Judicial Magistrate, lst Class, Saran at Chapra in connection with Chapra Town PS Case No. 467 of 2017.
