Petitioner apprehends his arrest in connection with Laheri P.S. case no. 127 of 2017, registered under Sections 420, 406, 467 and 468 of the IPC.
The informant alleged that a non banking Company called Enormous Company Industry Limited received deposits from several depositors including the informant and later closed the Company and misappropriated the deposits.
Learned counsel submits that he is only an Assistant Data Entry Operator in the Company. It is further submitted that the Company was actually run by the Managing Director and other Branch Managers who may be involved in the swindling of the money. However, for securing the privilege of anticipatory bail,
Patna High Court Cr.Misc. No.3013 of 2018(2) dt.18-01-2018 2/3 petitioner would be ready and willing to deposit some amounts as directed by this Court.
In view of the above, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Nalanda at Biharsharif in connection with Laheri P.S. case no. 127/2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions:
(i) One of the bailors shall be the own/close family member of the petitioner.
(ii) No sooner the charges are framed, petitioner shall appear in person before the Court below on each and every date fixed thereat. In case of default in doing so on two consecutive dates without any cogent/satisfactory reason, the trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
(iii) Along with the bail bonds the petitioner shall produce receipt showing deposit of a sum of Rs. 15,000/- (Fifteen thousand) with the Nazarat of the Civil Court. The deposits so
