The petitioner is in custody since 09.03.2019 in connection with S.Tr. No. 297 of 2019 arising out of Lauriya P.S. Case No. 59 of 2019 registered for the offence punishable under Sections 366/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the victim girl is a major and had gone with the petitioner of her sweet-will, the petitioner is facing prosecution. It is further submitted that in the statement made before the Magistrate under Section 164 Cr.P.C. the victim girl had herself stated that the petitioner had not established any sexual relationship with her and the petitioner had taken her, but she had gone willingly.

No. 297 of 2019 arising out of Lauriya P.S. Case No. 59 of 2019.
