Heard learned counsel for the petitioner and learned APP, Mr. Chandra Bhushan Prasad.

On inquiry of the court with regard to the stage of the case, the learned counsel for the petitioner submits that despite his best endeavours, he could not seek instruction from the petitioner nor the petitioner ever contacted him in these six years, as such he is not in a position to inform the court about the present status of the case.

At this stage, the learned APP submits that the petitioner is seeking quashing of an order dated 4-8-2016 passed by the learned JM 1st Class, Laheriya Sarai (Darbhanga) in C.R Case No. 186 of 2016 whereby cognizance of offences under

Patna High Court CR. MISC. No.54463 of 2017(2) dt.06-12-2023 2/2 Section 138 of the N.I. Act has been taken.

It is next submitted that much water has flown from 2016, it may be a possibility that trial might have concluded by now and thus the petitioner never contacted the learned counsel for the petitioner.

Considering the submission made by the learned APP, the court is not inclined to entertain the quashing application and the same is rejected.
