Heard learned counsel for the parties concerned. 2.

The present petition has been filed for modification of the order dated 11.08.2023, passed by this Court in Cr. Misc. no. 49560 of 2023.

Learned counsel for the petitioner submits that vide aforesaid order, the petitioner was directed to surrender before the learned court below within a period of four weeks from the date of order but due to non-communication of the order within the stipulated period of four weeks, he could not surrender within time and could not furnish the bail bonds, as directed by this Court.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel

Patna High Court CR. MISC. No.73685 of 2023(2) dt.24-11-2023 2/2 for the petitioner as also taking into account the averments made in the present petition, order dated 11.08.2023, passed in Cr. Misc. no. 49560 of 2023 is modified and now, the petitioner is directed to surrender before the learned court of learned Exclusive Special Judge, Excise Court-II, Siwan, within a period of three weeks from today, subject to deposit of a sum of Rs. 5,000/- before the District Legal Services Authority, Siwan. 5.

The present petition stands allowed with the aforesaid modifications.
