This application has been filed for modification of order dated 4.7.2019 passed in Cr. Misc. No.40521 of 2019 by which the earlier order dated 8.4.2019 passed in Cr. Misc. No.8.4.2019 passed in Cr. Misc. No.58005 of 2018 has been modified to the extent that the petitioner will deposit the remaining amount through the bank draft in favour of the Bihar State Food Corporation and the learned court below will examine the same and once the total amount is deposited and the court is satisfied, he will release the petitioner on bail. Submission of the learned counsel for the petitioner
Patna High Court CR. MISC. No.79370 of 2019(2) dt.05-02-2020 2/2 is that instead of submitting bank draft he has deposited the same in the Gopalganj Central Co-operative Bank Ltd., Gopalganj, Bihar, which will appear from annexure-2. Heard APP and the learned counsel for the B.S.F.C. In such view of the matter, this application is disposed of with a direction to the learned court below to verify the veracity of the annexure 2 and if it is found to be true, on surrender of the petitioner, he will be released on bail in connection with Thawe P.S.Case No.152 of 2018 with condition as mentioned in the earlier order.
