Having been lodged in jail custody since 26.08.2017 in connection with Marhaura P.S. Case No. 291 of 2017 registered under sections 302 and 120-B/34 IPC and section 27 of the Arms Act, the petitioner has prayed for bail. The mother of the informant was shot at the dead of night. On hearing the sound of gunshot, the informant came out of the house and found the petitioner along with others escaping from the place of occurrence.
Learned counsel for the petitioner submits that there is no eye-witness to the assault. There was no motive for the petitioner to commit the crime. As alleged by the prosecution, the same was in respect of other co-accused(s).
Patna High Court Cr.Misc. No.50587 of 2017(2) dt.17-10-2017 2/2 Counsel for the State opposed the prayer and submitted that the petitioner was identified at the place of occurrence by the informant in the flash of torch. There is some criminal antecedents of the petitioner.
Considering the facts and circumstances of the case, prayer for bail is refused. If the charges are not framed and trial taken up within 07 months, the petitioner shall have liberty to renew his prayer for bail.
