The petitioner is in custody in a case registered for offence punishable under Section 392 of the Indian Penal Code. This is a case of robbery lodged against the petitioner and the petitioner has been remanded in this case. It is submitted that the petitioner has falsely been implicated in this case and nothing has been recovered from him. The petitioner is in custody in this case since 26.11.2021. It is also submitted that similarly situated accused person is getting the privilege of bail vide Cr. Misc. No. 33237 of 2022 by order dated 02.09.2022 The learned Additional Public Prosecutor for the State vehemently opposed the prayer for bail.

Case No. 827 of 2020 to the satisfaction of the Chief Judicial Magistrate, Supaul.
