The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Paroo P.S. Case No. 120 of 2019 (District Muzaffarpur) registered for the offence under sections 147, 341, 323, 307, 354, 337 and 338 of the Indian Penal Code.

As per the allegation in the FIR, the petitioner is alleged to have assaulted Pawan Rai with 'sariya' as a result of which he sustained injury on head.

It is submitted by learned counsel for the petitioner that from perusal of the injury report of the said Pawan Rai it would transpire that he sustained simple injury and as such the allegation leveled in the FIR has not matched with the injury

Patna High Court CR. MISC. No.68317 of 2019(2) dt.20-11-2019 2/2 report. It is further submitted that the allegations are incorrect. The application for bail is opposed by learned APP for the State submitting that the petitioner is named in the FIR and there is direct allegation against him.

Having heard the learned counsel for the parties and taking into consideration the direct allegation against the petitioner of having assaulted Pawan Roy with 'sariya', the Court is not inclined to enlarge the petitioner on bail and as such his prayer for bail is rejected.
