The petitioner seeks bail in connection with Akorhigola P.S. Case No.225 of 2017 registered under Section 30(a), 34 and 47 of the Bihar Prohibition and Excise Act. The accusation is that in course of checking of the vehicles, two motorcycles were intercepted by the police. While three persons succeeded to flee away but the petitioner was apprehended with one motorcycle. On query, the petitioner disclosed the name of his one associate as Anjay Paswan, the owner of one motorcycle, who succeeded to flee away. On search of both the motorcycles, 20 liters country made liquor, kept in plastic bags, from each of the motorcycle was recovered. Learned counsel for the petitioner submits that, in fact, the

No.16571 of 2018(2) dt.28-03-2018 2/2 motorcycle was driven by the co-accused Anjay Paswan on which the petitioner was pillion rider from which 20 liters country made liquor, kept in plastic bag, is said to be recovered. The petitioner had no knowledge about the other two persons, who succeeded to flee away, leaving another motorcycle. The petitioner having no criminal antecedent is in custody since 16.12.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge (Excise), Rohtas at Sasaram, in connection with Akorhigola P.S. Case No.225 of 2017.
