JUSTICE ARUN KUMAR ORAL ORDER 09-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kalyanpur P.S.Case No. 157 of 2017 registered under Sections 216, 307, 353, 414 and 429 of the Indian penal Code and Section 25(1-b),a,26, 27 and 35 of the Arms Act. Submission is that as per allegation occurrence was committed by a gang of criminals and petitioner has clean antecedent and he has been implicated merely on the basis of confessional statement of Ram Singh, however Dharmendra Singh, one of the accused named in the FIR, and others were admitted to bail by a co-ordinate Bench of this Court vide order dated 18.12.2017 passed in Cr. Misc. No. 58553 of 2017, vide order dated 17.11.2017 in Cr. Misc. No. 54972 of 2017 and vide order dated 12.12.2017 in Cr. Misc. No. 58322 of 2017 and the

Patna High Court Cr.Misc. No.4298 of 2018 (3) dt.09-03-2018 2/2 petitioner's case stands on better footing.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Upendra Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 9th ACJM, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 157 of 2017.
