JUSTICE ARUN KUMAR ORAL ORDER 16-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.10.2017, seeks bail in Motipur PS Case No. 377 of 2017 registered under Sections 399, 402, 413, 414 of the IPC, Section 25(1-b)a, 26, 35 of the Arms Act and Sections 20/22 of the NDPS Act.

The allegation in brief is that one loaded country made pistol has been recovered from possession of the petitioner, other arms were recovered from other accused persons, motorcycle parts from other accused persons, 50 grams of Ganja from the dickey of one of the motorcycle and 150 grams of Granja from the dickey of another motorcycle.

Learned Counsel for the petitioner submits that he seeks bail of the petitioner on the ground of parity as another co-accused Ramit Kumar Yadav has been granted bail by this Court vide Cr. Misc. No. 21379 of 2018, moreover the petitioner has clean antecedent and is in custody since 18.10.2017.

Having considered the said facts and circumstances, the petitioner, namely, Deo Kumar Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge, Muzaffarpur in connection with Motipur PS Case No. 377 of 2017.
