The petitioner apprehends his arrest in connection with Mehandia P.S. Case No.62 of 2019 registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that the petitioner took the paddy worth Rs.2,92,336/- from the informant on assurance to return the aforesaid money after selling the same regarding which for the security, the informant also prepared the document on the stamp paper but the petitioner did not return the money. Learned counsel fort he petitioner submits that, in fact, the petitioner had purchased the paddy from the informant on assurance to return the money after selling of the paddy. For

Patna High Court CR. MISC. No.61799 of 2019(2) dt.15-10-2019 2/2 security, the informant also prepared the document on the stamp paper. Later on, after selling of the paddy, the petitioner returned the money to the informant but with an ulterior motive, the informant lodged the present case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Shubhnandan Jha, Chief Judicial Magistrate, Arwal, in connection with Mehandia P.S. Case No.62 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
