JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 06-12-2024 The present application has been filed for restoring CWJC No. 14300 of 2016 to its original file which was dismissed for default by order dated 29.08.2024 passed by this Court.
2. Learned counsel for the petitioner submits that the aforesaid writ application along with interlocutory application was filed on 16.01.2024. It is further submitted that although the Vakalatnama was filed by the learned advocate but the name of the learned advocate was not reflecting in the cause list, and therefore, he could not appear on the dates on which the case was listed and consequently the aforesaid case was dismissed
Patna High Court MJC No.3370 of 2024(2) dt.06-12-2024 2/2 for default. Learned counsel, therefore, prays that the aforesaid case bearing CWJC No. 14300 of 2016 be restored to its original file.
3. Considering the statement made in the application and submissions made in support thereof, the application is allowed and CWJC No. 14300 of 2016 is restored to its original file and number.
