Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 2, Rohit Kumar, who has been arrested during pendency of the anticipatory bail application. 3.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to petitioner No. 2, Rohit Kumar.

The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.67526 of 2025(2) dt.23-09-2025 2/3 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are mother and son and the informant alleges that on 22-6-2025 his uncle Dinesh started constructing wall on his land, on objection 13 named accused including the petitioners came and Ram Kumar and Dinesh assaulted his brother and sister by rod and kulhari, further Ram Kumar assaulted Arti by rod on eye and head causing injury, while Surendra assaulted Vicky by bamboo on back and Surendra took Rs. 40,000 from his pocket while Prince snatched chain of his sister.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioners and the informant are related and are having dispute relating to land and from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioners.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner Nos. 1 and 3, abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Samastipur (Muffasil) P.S. Case No. 275 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS. (Satyavrat Verma, J) Sumit/- U T
