1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has filed the instant application for grant of regular bail in connection with Munger Muffasil P.S. Case No. 09 of 2023 registered under section 341, 323, 325, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation against the petitioner in FIR is that first he put the pistol on the temple of the informant and when the informant tried to run away, he fired and the bullet hit on toe of left leg of the informant. It is further alleged that when informant entered his house, the FIR named accused persons started firing.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

As per Annexure-2, doctor opined injury sustained by the injured is simple in nature which is on his left index finger which is not a vital part of the body. It is further submitted that the petitioner is languishing in judicial custody since 01.08.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Munger Muffasil P.S. Case No. 09 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger.
