The petitioner seeks bail in connection with C.I. Case no. 260 of 2018 registered under Section 30(a) read with Section 13 of Bihar Prohibition & Excise Act-2016. 22 lts. of toddy is said to have been recovered from the house of the petitioner and petitioner was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. She has no concern with the seized toddy. The house from where the aforesaid toddy is said to have been recovered, is inhabited by several other family members of the petitioner and she had no knowledge of keeping

Patna High Court Cr.Misc. No.21624 of 2018(2) dt.17-04-2018 2/2 the said toddy in the house. She happens to be lady. She has no criminal antecedent. She has been languishing in custody since 25.02.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-III-cum-Special Judge, Excise, Katihar in connection with C.I. Case no. 260 of 2018.
