JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 06-10-2015 Petitioner retired from service way back in the year 2002. He is looking for the benefit of not only ACP but even MACP. The provision of ACP was notified in the year 2003 and the same was made effective from 9.8.1999 which was anti stagnation measure. So far as M ACP is concerned it came into play on 1.1.2009. Since petitioner retired in 2002, none of the scheme will actually cover him. It is basically a desperate measure by him to look for grant of benefit which is non- existent in terms of prevalent rules in this regard. Writ has no merit. It is dismissed.
