The petitioner seeks bail in Rupaspur P.S. Case No. 254 of 2017 registered under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. One country made pistol and two cartridges are said to have been recovered from the possession of the petitioner and the petitioner was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely implicated in the case at the instance of his enemies by planting
Patna High Court Cr.Misc. No.5307 of 2018 (3) dt.20-02-2018 2/2 the aforesaid recovery from his possession. He has no criminal antecedent and has been languishing in custody since 04.08.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Rupaspur P.S.
