The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, there is specific allegation against petitioners that they brutally assaulted the informant and his brother, as a result of which informant sustained head injury and his brother sustained injury on his head, right leg and shoulder.

It is submitted that petitioners have been falsely

The police after investigation submitted chargesheet under Sections 341, 323, 325, 504 and 34 of the Indian Penal Code, but differing with the same learned court below took cognizance under Section 307 and other allied sections of IPC. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Biraul, Darbhanga in connection with Biraul P.S.
