JUSTICE ARUN KUMAR ORAL ORDER 16-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Belhar P.S.Case No. 20 of 2018 registered under Sections 387 and 506/34 of the Indian penal Code. Allegation in brief is that informant, a police officer, received a secret information that petitioners and others asking for Rs. 5 lacs from a construction company engaged in construction of bridge, as extortion money to continue the work. Submission is that no any employee of the construction company has levelled allegation against these petitioners and they have clean antecedents but subsequently one case under the Excise Act was instituted against the petitioners and they are in custody since 09.02.2018.
Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.21680 of 2018(2) dt.16-04-2018 2/2 the petitioners, namely, Prakash Yadav and Arvind Yadav are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Banka in connection with Belhar P.S. Case No. 20 of 2018.
