JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 307,326/34 of the Indian Penal Code and 27 of Arms Act.

The petitioner is not named in the FIR and the named FIR co-accused Ram Bihari Choudhary has already been allowed bail by a Coordinate Bench of this Court on 20.10.2016 in Cr.Misc.No. 35061 of 2016.

Learned counsel for the State opposed the prayer for bail on the ground that the petitioner is an accused in several other criminal cases.

Submission of the petitioner is that co-accused

Patna High Court Cr.Misc. No.50633 of 2017 (3) dt.03-01-2018 Azad Paswan who is carrying several criminal cases has already been granted bail by a Coordinate Bench of this Court on 14.02.2017 in Cr.Misc.No.52977 of 2016.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Koran Sarai Police Station Case No.29 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
