Petitioner, already in custody, seeks bail in connection with Balrampur P.S. Case No.194 of 2017, registered under Sections 272 and 273 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that approximately 107 liters of foreign liquor was being carried in the Indigo car kept in the dickey, the petitioner had taken lift and the owner and driver of the vehicle Ashish Kumar Jha were also apprehended on the spot and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, petitioner Ashwani Kumar Yadav is directed to be released on

Patna High Court Cr.Misc. No.3291 of 2018(3) dt.31-01-2018 2/2 bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II cum Special Judge, Excise Act, Katihar in connection with Balrampur P.S.
