2. This application for grant of anticipatory bail arises out of Ghosi Police Station Case No. 300 of 2025, disclosing offences under Sections 316(5) and 318(4) of B.N.S.

3. As per the allegation, the petitioner obtained the post of Panchayat Teacher in Primary School on the basis of fake educational and eligibility certificates.

4. Learned Senior Counsel for the petitioner submits that petitioner has already resigned from the post of

Patna High Court CR. MISC. No.69419 of 2025(2) dt.08-10-2025 2/3 teacher by submitting a resignation letter dated 10.06.2025 before the headmaster of the Primary School Khirautigarh Ghosi. The copy of the resignation submitted by the petitioner has been annexed at Annexure-2. After the resignation of the petitioner, the present FIR has been lodged on 21.06.2025. He further submits that the large number of cases, this Hon'ble Court has granted anticipatory bail after termination of the teacher or resignation submitted by the teachers against whom the similar allegation of obtaining the employment on the basis of fake certificates.

5. Considering the fact that petitioner has already resigned and the fact that the allegation against the petitioner is based upon document for which custodial interrogation may not be required, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
