JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-02-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

The petitioner in association of other co-accused is said to have killed the father of the informant. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to ulterior motive. It is further submitted that the date of occurrence is 10.03.2022 at 3:30 AM to 3:45 AM but the FIR has been

The delay of about more than 36 hours in lodging the FIR shows the malice intention of the informant, whereas the distance of place of occurrence to the police station is only 6 kms. It is also submitted that after completing the investigation the police has submitted final form showing the petitioner as not sent up for trial and submitted charge sheet against non FIR accused persons but differing with the final form the learned Court below took cognizance against the petitioner. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

Learned APP assisted by learned counsel for the informant vehemently opposed the prayer of bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Cheria Bariyarpur (Manjhaul O.P.) P.S. Case
