====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 24-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Prohibition and Excise P.S. Case No. 477 of 2025, registered for the offences under Section 30(a)/ 32(i)(iii), 4141(i)(ii) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, petitioner and coaccused persons were apprehended with recovery of 74.490 litre of foreign liquor from the car in which they have been travelling.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submits that nothing incriminating has been recovered from person or

The petitioner is a Asha worker who went to PGI, Lucknow along with one patient from SKMCH, Muzaffarpur and while returning she took a lift in the alleged car. She had no knowledge about liquor kept in the car. The petitioner has clean antecedent and she is in custody since 30.07.2025.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery has been shown the conscious possession of the petitioner and also considering the period of custody of the petitioner and her clean antecedent, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise-II, Kaimur/concerned court, in connection with Prohibition and Excise P.S. Case No. 477of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
