JUSTICE MIHIR KUMAR JHA ORAL ORDER 16-02-2015 Heard learned counsel for the parties.
Having regard to the fact that the opposite parties do not have access to OMR answer sheet of the petitioners this Court would not find them to be in contempt because whatever was observed in the connected writ application was subject to availability of such answer sheet. As a matter of fact the opposite parties have been more than fair in at least giving supply of those answer sheet which could become available to them from the agency which had evaluated the OMRs.
Considering all these aspects of the matter, this Court does not find any reason to initiate contempt proceeding against the opposite parties in view of limited nature of observations made in order passed in the connected writ application. These applications, accordingly, fail and are dismissed. surendra/- (Mihir Kumar Jha, J) U
