====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in registered for the offences punishable under Sections 323, 302, 307/34 and other allied sections of the Indian Penal Code.

As per prosecution case, on 24.07.2020 at about 07.00 A.M., while brother of the informant was sitting at his house, this petitioner along with two other F.I.R. named accused persons came and assaulted him by means of iron rod as a result of which, he died during course of the treatment. Learned counsel for the petitioner submits that allegation against the petitioner is general and omnibus and he has falsely been implicated in the present case due to village politics.

No.74828 of 2022(2) dt.24-03-2023 2/2 Learned counsel for the State opposes the prayer for bail application and submits that there is specific and direct allegation against the petitioner that he along with other two coaccused persons brutally assaulted the brother of the informant resulting in his death.

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
