Mr. SRI NARSINGH TANTI ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with S. Tr. No. 700 of 2017 arising out of Masaurhi P. S. Case no. 234 of 2017 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. Informant is the daughter of the deceased, who in her written complaint has stated that on 21.6.2017 her mother at about 8 A.M. left house for her maternal home. There was some altercation with her brother-in-law and sister-in-law and on 22.6.2017 in the morning she left her maternal home and thereafter became traceless. After much search at about 11 A.M. an unidentified dead body was found near Massaurhi and she identified the dead body of her mother. She has further stated that there was some dispute with one Yogeshwar Prasad

Patna High Court Cr.Misc. No.5577 of 2018(3) dt.27-02-2018 2/2 with respect to some money transaction and there was also some land dispute. She has alleged that on account of dispute she has been killed.

It is submitted on behalf of petitioner that he is not named in the FIR. His name has surfaced on the basis of confessional statement made by Anil Kumar. It has further been stated that Anil Kumar has been granted bail by the court below and except confessional statement made by Anil Kumar there is nothing against him. Petitioner is in custody since 30.7.2017 and he has no criminal antecedent.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XI, Patna, in connection with S. Tr. No.700 of 2017 arising out of Masaurhi P. S. Case no. 234 of 2017. (S. Kumar, J) sudip/- U T
