JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Katihar Rail P.S. C-II Case No.2 of 2017, a case under Section 3(A) R.P.(U.P.) Act.

Petitioner is in custody since 17.01.2017 with allegation that he was apprehended while carrying stolen railway property.

Earlier prayer for bail was refused in Cr. Misc. No.15908 of 2017. The report of the learned trial Judge dated 15.12.2017 would reveal that the case is still pending for prosecution evidence before charge.

Considering the period already undergone by the

Patna High Court Cr.Misc. No.53811 of 2017 (4) dt.03-01-2018 P2/ petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
