JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Dhibra PS Case No. 10 of 2014 registered under Sections 147, 148, 149, 307, 302, 120(B), 353, 124A of the IPC, Sections 3⁄4 of the Explosive Substances Act and Section 17 of CLA Act.

The allegation in brief is that a time bomb was planted under a road, on getting information the police tried to defuse the bomb but it exploded as a result of which two CRPF personnel died and several others got injured.

Learned Counsel for the petitioner submits that merely on suspicion the petitioner was made accused, except suspicion raised against him there is no other material, besides two criminal antecedent and one of the FIR named co-accused Abhay Yadav has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 31771 of 2017.

Having considered the said facts and circumstances, the petitioner, namely, Satyendra Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM (FTC

Patna High Court Cr.Misc. No.4443 of 2018 (4) dt.15-03-2018 VII), Aurangabad in connection with Dhibra PS Case No. 10 of 2014 on the following conditions:- (i) One of the bailors must be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
