The petitioner, already in custody, seeks bail in connection with Pirpainty P. S. Case No. 309 of 2015, registered under Sections 302/34,120 (B) of the Indian Penal Code and 27 of the Arms Act.
Allegation in brief is that the F.I.R. named accused persons killed the informant's husband, while returning back to home.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name only transpired on the confessional statement of co-accused Kursail Yadav and Kursail Yadav was made accused on confessional statement of one Bhakuli Yadav @ Lalnjeet Yadav and those two persons have
Patna High Court Cr.Misc. No.9822 of 2018 (2) dt.19-02-2018 2/2 been granted bail by Co-ordinate Benches of this Court vide order dated 13.05.2016 passed in Cr. Misc. No. 20420 of 2016 and 08.04.2016 passed in Cr. Misc. No. 14513 of 2016, except that there is no other material against the petitioner and he has clean antecedent. The petitioner is in custody since 13.07.2017. Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District Judge, Bhagalpur in connection with Sessions Trial No. 02 of 2018 (arising out of Pirpainty P. S. Case No. 309 of 2015), Bhagalpur.
