ANJANA MISHRA ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.09.2017 in connection with Khagaul P.S. Case No.125 of 2017 registered for the offence under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner and only because the vehicle was recovered from parking where the petitioner is living, his name has been brought in connection with the present case. The petitioner further submits that there is no evidence in the entire investigation to indicate that the petitioner had taken the vehicle so stolen. It is further submitted that till date, the petitioner has not been placed on T.I. Parade. It
Patna High Court Cr.Misc. No.7953 of 2018 (3) dt.05-03-2018 2/2 is submitted that in connection with theft of the same vehicle, another case was registered, bearing Rupaspur P.S. Case No.277 of 2017, in which the petitioner has already been granted bail in Cr.Misc. No.7893 of 2018, vide order dated 08.02.2018.
Considering the fact that two cases were filed for the alleged theft of one vehicle and that the petitioner has already been in custody since 18.09.2017, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Danapur, in connection with Khagaul P.S. Case No.125 of 2017.
