Case No. 03 of 2017, arising out of Barachatti P.S. Case No. 423 of 2016, registered for the offences punishable under Sections 420, 467, 468, 471, 120B, 414 of the Indian Penal Code and Sections 8, 20B(ii)(b), 22, 25 & 29 of N.D.P.S. Act.
Allegation as per FIR is of recovery of 100 kg. of ganja from a car and petitioner and other accused persons were arrested at the spot.
Submission of learned counsel for the petitioner is that other co-accused have been granted bail by the the coordinate Bench of this Court vide order dated 18.10.2017 passed in Cr.Misc.No. 41764 of 2017 and vide order dated 19.9.2018 passed in Cr.Misc.No. 45053 of 2018 and petitioner is in custody since 24.10.2016.
Patna High Court CR. MISC. No.68334 of 2019(3) dt.18-12-2019 2/2 Heard learned APP and perused the report, from which it appears that out of six witnesses four have been examined.
In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, if the trial is not concluded within a period of six months, petitioner is at liberty to renew his prayer for bail. At the same time, S.S.P., Gaya is directed to produce the remaining witnesses in court on the date fixed. This application is, accordingly, dismissed.
